The paperwork trap

A lien waiver is often treated like an administrative form. It is not just a form. It can decide whether your shop keeps a powerful payment remedy.

The dangerous version says payment has been received or rights are released even when you are still waiting on funds. That is backwards. Payment paperwork should match reality.

How to read it

Check whether the waiver is conditional or unconditional. Then check what it covers. A progress payment waiver should not accidentally release final payment, retainage, disputed changes, or work after the stated through-date.

If the GC wants a waiver before releasing a check, ask for conditional language that becomes effective only after payment clears.
